CuraCara — Terms and Conditions

  These Terms and Conditions ("Terms") govern your use of the CuraCara mobile application and any related services (together, "CuraCara" or the "Service") operated by Mary Smith. By creating a CuraCara account, joining a care circle, or otherwise using the Service, you agree to these Terms.

If you do not agree, do not use the Service.

  CuraCara is a coordination tool that helps families and paid caregivers share information about the care of a loved one. Caregivers can log medications given, meals, symptoms, tasks completed, and shift information. Coordinators can invite team members and manage the care plan.

CuraCara is not a medical device, is not a substitute for professional medical judgment, and does not provide medical advice. The information caregivers log in CuraCara is a record-keeping and communication tool, not a diagnostic or treatment tool. Always consult qualified healthcare providers about the care of the person you support.

  You must be at least 18 years old to create a CuraCara account or accept an invitation to join a care circle. By using the Service you represent that you meet this requirement.

  You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your sign-in method (phone number, email, verification codes), and for all activity that occurs under your account.

Notify us immediately at support@curacara.comif you believe your account has been used without your permission.

  You agree not to:

● Use the Service for any unlawful purpose or in violation of applicable laws

● Enter information about another person without a legitimate care relationship and, where required, that person's or their legal representative's consent

● Attempt to access data belonging to other care circles or interfere with the security or integrity of the Service

● Reverse engineer, decompile, or otherwise attempt to extract source code from the app

● Use the Service to send spam, harassment, or content that violates any third party's rights

 You retain ownership of the information and content you enter into CuraCara. By using the Service you grant CuraCara a limited license to store, display, and process that content solely to provide the Service to you and the other members of your care circle.

Care circle members can see the information you contribute. Do not enter information you are not comfortable sharing with the other members of your circle..

  CuraCara sends text messages as part of the Service. Enrolling in the SMS program is voluntary and consented to at the time you provide your phone number or accept an invitation.

● Program name: CuraCara

● Description: One-time sign-in verification codes, care circle invitations, and optional care notifications (medication reminders, shift reminders, symptom alerts).

● Message frequency: Variable and event-driven. You will receive messages only in response to actions you take (signing in, accepting invitations) or events you have opted into (care notifications). Volume is typically low — a handful of messages per week at most.

● Message and data rates may apply. Your mobile carrier's standard messaging and data rates apply to all messages sent to and from CuraCara. Check your plan.

● Opt out: Reply STOP to any CuraCara message to stop receiving future messages. Reply START or UNSTOPto resume.

● Help: Reply HELP to any CuraCara message for support contact information, or email support@curacara.com.

● Carrier disclaimer: Carriers (including AT&T, T-Mobile, Verizon, and their subsidiaries) are not liable for delayed or undelivered messages.

● Your mobile information will not be shared or sold. Phone numbers and any related opt-in data are used solely to deliver the messages described above, and are not shared with third parties or affiliates for marketing or promotional purposes.

 Our collection and use of your information is governed by our Privacy Policy, which is part of these Terms.

You may stop using the Service and delete your account at any time by emailing privacy@curacara.com.

We may suspend or terminate your access to the Service at our discretion if you violate these Terms, if it is required by law, or if we discontinue the Service.

Removal from a care circle does not delete the historical records tied to actions you already took (for example, doses you logged remain part of the care record for that patient).

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED OPERATION. CURACARA DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, THAT NOTIFICATIONS OR REMINDERS WILL ALWAYS BE DELIVERED ON TIME, OR THAT THE SERVICE MEETS ANY SPECIFIC HEALTHCARE STANDARD.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CURACARA AND ITS OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, LOSS OF USE, OR LOSS OF GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

You agree to indemnify and hold harmless CuraCara and its operator from any claim, loss, or expense arising out of your use of the Service or your violation of these Terms.

These Terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Texas, and you consent to the jurisdiction of those courts.

We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top and, when the changes are material, notify affected users in-app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
